1. Agreement
These Terms of Use ("Terms") govern your access to and use of the Manna platform ("Service"), operated by M-Chat (Pty) Ltd ("we", "us", "Manna"). By using the Service, you agree to be bound by these Terms. If you do not agree, please do not use the Service.
2. Service description
Manna is an AI-powered ministry assistant platform that enables churches and religious organisations to communicate with their congregations through messaging platforms including WhatsApp, Instagram, Facebook Messenger, and website chat. The Service includes chatbot automation, live chat handover, content delivery, and related tools.
3. Eligibility
The Service is intended for use by churches, religious organisations, and their authorised representatives. You must be at least 18 years old to create an account. By registering, you represent that you have the authority to bind your organisation to these Terms.
4. Account responsibilities
You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You agree to notify us immediately of any unauthorised use. Manna is not liable for losses caused by unauthorised access to your account.
5. Acceptable use
You agree to use the Service only for lawful purposes consistent with its intended use as a ministry communication tool. You may not:
- Use the Service for spam, unsolicited marketing, or messages unrelated to your church's ministry
- Transmit content that is defamatory, abusive, threatening, or violates any person's rights
- Attempt to access other users' data or interfere with the Service's infrastructure
- Use the Service in any way that violates applicable laws, including the Protection of Personal Information Act (POPIA)
- Resell, sublicense, or redistribute the Service without written consent
6. Content and data ownership
You retain ownership of all content and data you provide through the Service, including member information, sermon content, and church communications. We do not claim ownership of your data. You grant us a limited licence to process your content solely for the purpose of providing the Service.
7. Subscription and billing
Paid plans are billed monthly or annually as selected at signup. Prices are in South African Rand (ZAR) unless otherwise stated. All fees are exclusive of VAT where applicable. We reserve the right to change pricing with 30 days' written notice. You may cancel your subscription at any time — cancellation takes effect at the end of the current billing period.
8. Free trial
We may offer a free trial period. At the end of the trial, your subscription will begin at the applicable plan rate unless you cancel before the trial ends. No charges are applied during the trial period.
9. WhatsApp and third-party costs
The Service uses the WhatsApp Business API and other third-party messaging platforms. Meta (WhatsApp) charges per-message fees for certain message types. These costs are separate from Manna subscription fees and are passed through at cost with no markup. You are responsible for understanding and budgeting for these costs.
10. Service availability
We aim for high availability but do not guarantee uninterrupted access. We may perform maintenance, updates, or experience outages. We will provide reasonable notice of planned downtime where possible. Current system status is available at m-chat.instatus.com.
11. Limitation of liability
To the maximum extent permitted by South African law, Manna's total liability for any claim arising from the Service shall not exceed the amount you paid to us in the 12 months preceding the claim. We are not liable for indirect, incidental, special, consequential, or punitive damages, including loss of data, revenue, or ministry opportunities.
12. Termination
Either party may terminate the agreement at any time. Upon termination, your access to the Service will cease. You may request an export of your data within 30 days of termination. After 30 days, we may delete your data in accordance with our Privacy Policy.
13. Changes to these terms
We may update these Terms from time to time. Material changes will be communicated via email or through the Service. Continued use after changes constitutes acceptance.
14. Governing law
These Terms are governed by the laws of the Republic of South Africa. Any disputes will be subject to the jurisdiction of the courts of KwaZulu-Natal.
